Black First Land First (BLF) is taking the Independent Electoral Commission (IEC) to court. The matter shall be heard on the 11th of April 2023 at the Durban High Court.

The fundamental rights to stand for elections was denied to 89 candidates of BLF in the 2021 Local Goverment Elections (LGE). The unlawful exclusion of these candidates was not of the making of BLF in that due to load-shedding, the electronic system didn’t accept the names of the candidates. BLF leadership then went to the eThekwini IEC offices to physically deliver the relevant information and documents but were again denied the right to submit. BLF then took the IEC to the High Court in eThekwini. Judge Nkosi ruled in favour of BLF. However, the IEC appealed against that decision. The matter was irregularly shifted to Judge Ploos instead of going back to Judge Nkosi. This new judge that presided irregularly over the matter found in favour of the IEC.

BLF has been involved in a protracted process of getting court transcripts and related documents. Now BLF is ready to lodge another court process to address the injustice suffered by the organisation. 89 candidates of BLF were irregurlaly excluded from the 2021 LGE. All these candidates were available to serve the eThekwini Metro. This unlawful exclusion of BLF must be addressed.
