Where is Mr Y Judge Zondo?

Black First Land First (BLF) is appalled by the systemic targeting of the party’s President, Andile Mngxitama, by the Zondo Commission.

In the notice marked 8th January 2021 the Commission‘s secretary who is the former President of Azapo, Professor Itumeleng Mosala, notified President Mngxitama that a government spy named Mr Y was going to implicate him in various unlawful activities such as money laundering, tax evasion and corruption. The notice further said that the spy would be protected by the Zondo Commission and his testimony would be in secret. No reasons were provided for this kangaroo court arrangement.

The secret testimony of the spy, Mr Y, is expected between 25th and 29th January 2021. Surprisingly only on Saturday 23rd January 2021, did the Commission send an email saying Mr Y will not testify but a substitute spy named Ms K will testify on the affidavit deposed by Mr Y.

No reasons for the sudden non availability of Mr Y were provided. BLF believes that the Commission is deliberately lying about the so called Mr Y’s non availability. We call on Judge Zondo to tell the nation under oath, where is Mr Y? Secondly, we are appalled by the obvious breaking of the rules of evidence by the Zondo Commission, including presenting through another person (Ms K) the evidence of Mr Y, which was deposed to in his affidavit. This is a comical situation of hearsay evidence, all calculated to tarnish the name of the President of BLF in a year of elections.

BLF has instructed its lawyers to advice on the way forward. It’s ironic that the Commission has elected to jump the unfinished testimony of Brian Molefe by bringing the proceedings to an end under the guise of one of its officials catching Covid-19. Now they are targeting Mngxitama who is a known opponent of white monopoly capital that seems to have captured the Zondo Commission.

We ask Judge Zondo to immediately disclose the truth about the spy named Mr Y.

BLF will in due course hold a press conference to reveal the dirty tricks of the Zondo Commission.

BLF believes the open bias of Judge Zondo shows that he has descended to naked hatred of President Zuma. It now seems that Judge Zondo has allowed his ambition to become Chief Justice to cloud his sense of fairness. Taking to the media to harangue President Zuma without so much as allowing reasonable time to formulate a response to the threat of a subpoena to appear before the impatient judge shows the hand of Judge Zondo. It is now clear that Judge Zondo is campaigning to get the nod for the job of Chief Justice by doing the dirty job of President Ramaphosa who is the main ideological foe of the Radical Economic Transformation agenda pushed by President Zuma.

It’s hard not to believe that Judge Zondo is not in a job-hunting spree. So determined is the judge to get the approval of President Ramaphosa who is the final arbiter in the appointment of the CJ, that Zondo has adopted an open antagonistic attitude towards President Zuma. No other witness has been treated in the openly biased and contemptuous manner as President Zuma has been subjected to. Minister Pravin Gordhan has openly defied the commission with no consequences. As a matter of fact, Judge Zondo is protecting Pravin Gordhan. BLF has submitted evidence of corruption implicating Pravin Gordhan to the commission. Initially, a date was given for BLF to appear before the commission. Then no further communication has been received from the commission despite numerous emails of enquiry from us.

It is clear that uZondo uzonda uZuma. It would seem that Judge Zondo has converted his ambition to be chief justice into hating President Zuma to ensure he is recognized as a defender of President Ramaphosa. This is unfortunate but provides enough reason to assume that President Zuma will be prejudiced by Judge Zondo. Zondo must do the right thing and recuse himself from any further hearing of the Zuma testimony.

The much anticipated Judicial Commission of Inquiry (JCOI) into State Capture is showing early signs of bias and inconsistencies. Black First Land First (BLF) asks the Deputy Chief Justice, Raymond Zondo, to be impartial and not play to the political gallery. The decision of the Judge to deny the Guptas the right to cross-examine witnesses via video link is not reaaonble or consistent.

The participation of the Gupta brothers in the JCOI is critical in helping the nation to get a full picture of the allegations. The denial of the brothers of this right has the impact of shielding witnesses who lied before the JCOI.

Judge Zondo has already accepted the argument of Mcebisi Jonas that he didn’t trust the South African law enforcement agencies. The Guptas have only echoed this claim which has been heard and not challenged by the JCOI.  Why is it okay for Jonas to make such a claim but not good enough when the Guptas make a similar claim?

We have seen that the Hawks act as private paratroopers of white monopoly capital. They arrested Duduzane Zuma and shackled him just to go to court to take away his rights to travel. The same Hawks asked for a six months postponement. This shows beyond doubt that they are abusing their powers and therefore the adversaries of white monopoly capital have a legitimate reason to question their integrity.

The second and glaring inconsistency shown by Judge Zondo is his refusal to grant the Guptas permission for cross examination by video link. Judge Zondo has already established a precedent by allowing the so called ‘state capture’ experts to testify via video link. Again the question arises – why the double standards when it is in relation to the Guptas?

BLF calls on Judge Zondo to review his decision so that the Guptas can state their side of the story and the nation can have the opportunity to make up its mind on an informed basis. Zondo is not presiding over a trial. In the event of his recommendations having criminal implications for witnesses then other mechanisms, including the law enforcement agencies and extradition treaties, will come into force. The Judge should not help the Hawks to harrass the Guptas via the back door. Let the truth come out. Let the Guptas testify via video link.

BLF has a big interest in the JCOI into State Capture to which it shall shortly be submitting over twenty matters.
