Black First Land First (BLF) agrees with King Mpendulo Zwelonke Sigcawu that its time to release the AbaThembu King Buyelekhaya Dalindyebo from prison. The King should never had been imprisoned in the first place. The denigration of African systems is occasioned by Roman Dutch and English foundations of the South African law which are anti black.
The subjection of the African criminal justice system to the Roman Dutch legal precepts is an insult to African law. Even the very idea of the division between civil law and customary law is a colonial notion imposed by the colonial minded drafters of the Constitution of South Africa. In truth the notion is crafted to legitimise Roman Dutch law as the supreme law.
African justice systems like all law is not static or perfect but, given the necessary conducive conditions, evolves with the primary function being the well-being of the community. When judges in the white legal system make bad decisions, they have immunity from prosecution. In countries for instance where the death penalty exists, innocent people are known to have been executed based on wrong judgments.
Government must decide if it respects the African system of justice or not. We can’t infantilise the African justice system in favour of the hostile and anti black Roman Dutch based legal system. Release the King now!
