Black First Land First (BLF) has resolved to take action against Judge Hans Fabricius who handed down one of the most atrocious judgments in recent times in the case of Oakbay Investments versus Bank of Baroda . The judgment by Fabricius on 21 September 2017 is a testament to the capture of the judiciary by white monopoly capital.
The judge dismissed the application by Oakbay Investments (Oakbay) in an openly biased and illegal manner. He showed via his judgment that he doesn’t care for the plight of the 7500 Oakbay workers who stand to loose their livelihoods upon closure of Oakbay’s bank account by the Bank of Baroda on 30 September 2017. It makes no sense why the judge didn’t grant Oakbay an extension of their relationship with the Bank of Baroda until the main application is heard in December this year. The judgment renders the envisaged main application by Oakbay to try and save its account with the Bank of Baroda superfluous.
BLF has had regard for the history of the judgments and jurisprudential outlook of Judge Fabricius and we have come to the determination that he is not a fit and proper person to be a judge of the High Court or of any other Court of this country. In this regard a number of actions shall be undertaken including:
1. Laying a complaint with the Judicial Conduct Committee of the Judicial Services Commission to have Judge Fabricius removed from the bench.
2. Opening a criminal case against Judge Fabricius on the evidence that he is working with enemies of Radical Economic Transformation such as the racist Organization Undoing Tax Abuse (OUTA).
BLF will submit a written statement of evidence to the police against Judge Fabricius. We call on all judges to resist capture by white monopoly capital in its quest to keep the South African economy in the hands of a minority.
